New Details Regarding Pending U.S. Supreme Court Case to be Revealed at ACSOL Conference

ACSOL Executive Director Janice Bellucci, who filed earlier today, a brief in the pending U.S. Supreme Court case regarding a Missouri state law, will reveal new details regarding that case during the ACSOL conference on Friday, October 2.  Attorney Bellucci has represented the registrant at every level in the case after he was convicted for failing to post a sign on his home on Halloween.

“This case has been pending for almost three years,” stated Bellucci.  “There is much to share about this case with those who attend the conference.”

The case was initially filed in a federal district court in Missouri on October 3, 2023. The trial court judge ruled in favor of the registrant and issued a permanent statewide injunction on October 2, 2024 that kept the state of Missouri from enforcing the Halloween sign requirement.  The 8th Circuit Court of Appeals upheld the trial court decision on January 2, 2026.

With both lower courts reaching a consensus on this with an action that favors a citizen over the government, I cannot see SCOTUS touching it with a 39 1/2 foot pole. But you have to come to the table ready for it anyway, because you never know what clever legal theory a judicial clerk could be whispering in a justice’s ear.
